Terms of Service
These Terms govern your use of Maks Sites (the “Service”), operated by maks.co (“we,” “us”). By using the Service you agree to these Terms and to our Privacy Policy.
1. What the Service does
You give us a website address (URL) for a business. We generate a redesigned previewof that business’s website using publicly available information from the site. A preview is an unofficial example/mockup created for evaluation. It is not affiliated with, authorized by, or endorsed by the business shown unless and until that business signs up.
2. Your authorization & license to us
By submitting a URL or using the Service, you represent that you are the business owner or are otherwise authorized to request a preview of that website. You grant us a non-exclusive license to access, copy, and process that website’s content, branding, and publicly posted reviews/testimonials for the purpose of creating, displaying, and improving your preview and the Service. You can ask us to take a preview down at any time (see Contact).
3. Previews & takedown
Previews are kept private/unlisted, marked as unofficial, and not submitted to search engines. If you are a business owner and want your preview removed, email us and we will remove it promptly.
4. Free preview; paid hosting
Generating and viewing a preview is free. If you choose to launch your site, hosting and maintenance is $49/month, billed through Stripe. The subscription automatically renews each month until you cancel. You may cancel at any time and your site will remain live through the end of the current paid period; fees already paid are non-refundable except where required by law.
5. Acceptable use
Don’t submit URLs you’re not authorized to use, abuse or overload the Service, attempt to access other tenants’ data, or use the Service for unlawful content. We may suspend abusive use.
6. Intellectual property
You retain rights to your business’s content and marks. We retain rights to the Service, our templates, and software. The new copy and design we generate for your site is licensed to you for use while your subscription is active.
7. Disclaimers & limitation of liability
The Service is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amounts you paid us in the prior three months.
8. Indemnification
You agree to indemnify us against claims arising from your submission of websites you were not authorized to submit, or your misuse of the Service.
9. Changes & governing law
We may update these Terms; continued use means you accept the changes. These Terms are governed by the laws of the State of Hawaii, USA.
